Magna Cartak berdintasun legala sartu du ordenamendu juridikoan.<\/p>\n<p><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2015-11430&amp;p=20240522&amp;tn=2\" target=\"_blank\" rel=\"noopener noreferrer\">Langileen Estatutua<\/a> arau bat da, non araupetzen den, sexua dela-eta diskriminaziorik egin ahal izan gabe, lanerako betebehar eta eskubidearekin lotutako alor guztiak, ogibidea eta lanbidea askatasunez aukeratzea, norbanakoaren eta familiaren premiak asetzeko ordainsari nahikoa jasotzea, etab..<\/p>\n<p>Berdintasun-araudia ordenamendu juridikoan jaso izanaren ondorioz, arau hori behin eta berriro aldatu behar izan da.<\/p>\n<p><strong>Lan-arriskuen prebentzio-araudia<\/strong> <a href=\"https:\/\/www.insst.es\/normativa\/colectivos\/pymes\" target=\"_blank\" rel=\"noopener noreferrer\">araudi-arkitektura batez<\/a> osatuta dago, hainbat errege-dekretu bidez zabaltzen den 31\/1995 Legea buruzagi duena. Une honetan eta Lan Segurtasun eta Osasunari buruzko Espainiako Estrategiak ezartzen duen bezala, berrikusten ari dira.<\/p>\n<div class=\"resaltado-borde\">\n<p><strong><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2007-6115\" target=\"_blank\" rel=\"noopener noreferrer\">Martxoaren 22ko 3\/2007 Lege Organikoa, gizonen eta emakumeen arteko berdintasun eraginkorrari buruzkoa. Finkatutako testua<\/a><\/strong><strong>: <\/strong>Nagusiki 2019. urtean aldatu zen lege organiko horrek <strong>lan<\/strong>-esparruarekin lotutako nobedade garrantzitsuak hartu ditu barne, emakumeen eta gizonen arteko tratu- eta aukera-berdintasuneko eskubidea<strong> eraginkor <\/strong>bilakatzeko, hain zuzen ere, emakumeekiko diskriminazioak ezabatuz.<br \/>\n<strong>IV aukera-berdintasuneko lanerako eskubidea izenburupean, \u00a0<\/strong>honako hauekin lotutako alderdiak bildu ditu:<\/p>\n<ul>\n<li>Emakumeen enplegagarritasuna hobetzea.<\/li>\n<li>Negoziazio kolektiboan berdintasuna sustatzea.<\/li>\n<li>Berdintasuna eta kontziliazioa.<\/li>\n<li>Berdintasun-planak eta berdintasuna sustatzeko bestelako neurriak.<\/li>\n<li>Delituak egitea eta laneko sexu-askatasunaren eta osotasun moralaren aurkako bestelako jarrerak agertzea prebenitzeko neurri zehatzak.<\/li>\n<li>Sexu-jazarpena eta sexuagatiko jazarpena prebenitzea.<\/li>\n<\/ul>\n<\/div>\n<div class=\"resaltado-borde\">\n<p><a href=\"https:\/\/www.boe.es\/eli\/es\/rd\/2020\/10\/13\/901\/con\" target=\"_blank\" rel=\"noopener\"><strong>Urriaren 13ko 901\/2020 Errege Dekretua, berdintasun-planak eta haien erregistroa arautzen dituena<\/strong> eta maiatzaren 28ko 713\/2010 Errege Dekretua aldatzen duena, laneko hitzarmenak eta akordio kolektiboak erregistratzeari eta gordailatzeari buruzkoa<\/a>: 3\/2007 Lege Organikoan aurreikusitako <strong>Berdintasun Planaren bitarteko <\/strong>eta erregistro, gordailu eta sarbidearekin lotutako betebeharrak garatzen dituen Errege Dekretua. Funtsezko alderdiak:<\/p>\n<ul>\n<li><strong>Negoziazio<\/strong> prozedura.<\/li>\n<li>\u00a0Planen <strong>Edukia<\/strong>:<strong> diagnostikoa<\/strong> azpimarratuz.<\/li>\n<li>Erregistroa, gordailua eta protokoloak.<\/li>\n<\/ul>\n<\/div>\n<div class=\"resaltado-borde\">\n<p><strong><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2020-12215\" target=\"_blank\" rel=\"noopener\">Urriaren 13ko 902\/2020 Errege Dekretua, emakumeen eta gizonen arteko ordainsari-berdintasunari buruzkoa:<\/a> <\/strong><strong>ordainsari-berdintasunari buruzko alorrean <\/strong>neurri zehatzak ezartzen dituen Errege Dekretua. Bertan, garatzen dira esparru horretan emandako diskriminazioa identifikatzeko eta zuzentzeko eta haren aurka borroka egiteko, beharrezko baldintzen alde eginez eta dauden oztopoak kenduz. Funtsezko alderdiak:<\/p>\n<ul>\n<li>Ordainsari-gardentasunaren eta balio bereko lanarengatik ordainsari bera derrigorrez jasotzeko printzipioa.<\/li>\n<li>Ordainsari-gardentasunerako tresnak: ordainsari-erregistroa eta ordainsari-ikuskaritza.<\/li>\n<li>Lanpostuen balorazioa hitzarmen kolektiboetan.<\/li>\n<\/ul>\n<\/div>\n<div class=\"resaltado-borde\">\n<p><strong><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2022-14630\">Irailaren 6ko 10\/2022 Lege Organikoa, sexu-askatasunaren berme integralari buruzkoa<\/a><\/strong>: LLege organiko horren xedea da sexu-askatasunerako eskubidea erabat bermatzea eta babestea eta sexu-indarkeria guztiak ezabatzea, baita<strong> lan-esparruan <\/strong>kontuan hartu behar diren nahitaezko alderdiak ere:<\/p>\n<ul>\n<li>Prebentzioa eta sentsibilizazioa lan-eremuan.<\/li>\n<li>Delituak eta sexu-askatasunaren eta osotasun moralaren aurkako beste jarduerak, lantokian, egitea saihesten duten lan-baldintzak, sexu-jazarpena eta sexuagatiko jazarpena bereziki azpimarratuz.<\/li>\n<li>Prozedura zehatzak horiek prebenitzeko eta biktimen salaketak edo erreklamazioak bideratzeko, baita eremu digitalean jasandakoak ere.<\/li>\n<li>Enpresek sentsibilizazioa sustatuko eta prestakuntza eskainiko dute, euren zerbitzura dagoen pertsona oro sexu-indarkerien aurka erabat babesteko.<\/li>\n<li>Emakumezko langileek betetzen dituzten lanpostuen arriskuen balorazioaren barruan, behin eta berriro errepikatzen diren lan-arriskutzat sartu beharko dute sexu-indarkeria, eta emakumezko langileei horri buruzko prestakuntza eta informazioa eskaini beharko diete.<\/li>\n<li>Gune publiko seguruak: lan-inguru seguruak eta irisgarriak emakumezko langileentzat.<\/li>\n<\/ul>\n<p><strong><a href=\"https:\/\/c190guide.ilo.org\/es\/\" target=\"_blank\" rel=\"noopener\">190. Hitzarmena Lanaren Nazioarteko Erakundea (LANE) indarkeria eta jazarpena lan-mundutik ezabatzeari buruzkoa<\/a>:<\/strong><\/p>\n<p>Espainia atxiki zaion Laneko Nazioarteko araua. Indarrean sartu zen 2023ko maiatzaren 25ean.<\/p>\n<p>Hori funtsezko dokumentua da emakumeen eta gizonen arteko lan-berdintasuna lortzeko. Pertsona orori aitortzen dio indarkeriarik eta jazarpenik gabeko lan-mundu bat, honela definituz: \u00abonargarriak ez diren jarreren eta praktiken multzoa, edo aipatutako jarreren eta praktiken mehatxuak, bai behin bakarrik izan eta bai behin eta berriro errepikatzen badira, kalte fisikoa, psikologikoak, sexuala edo ekonomikoa eragiten edo eragin badezakete\u00bb. Indarkeria eta jazarpena barne hartzen ditu, generoa dela eta, sexu-jazarpena barne.<\/p>\n<p>Hitzarmen horrek kontuan hartzen du lan-esparrua etengabe aldatzen ari den errealitate anitza dela, eta lanean ez ezik, lanarekin lotutako edo haren emaitza moduan ere eman daitekeen indarkeriari eta jazarpenari erreparatzen die.\u00a0 Hots, honako hau hartzen du kontuan:<\/p>\n<ul>\n<li>Lan fisikoaren tokia, gune publikoak eta pribatuak lantokiak direnean.<\/li>\n<li>Lanarekin lotutako leku-aldaketak, bidaiak, jazoerak edo gizarte- eta prestakuntza-jarduerak.<\/li>\n<li>Lanarekin lotutako bestelako lekutan, non langileari ordaintzen zaion, non atsedena hartzen duen edo non, jaten duen, non komunak eta aldagelak erabiltzen dituen.\u00a0 Hau da, guztiek erabiltzen dituzten guneak, hala nola jantokia, hartzen dira barne.<\/li>\n<li>Lanarekin lotutako komunikazioetan, baita informazioaren eta komunikazioaren teknologien bidez egindakoak ere.<\/li>\n<li>Enplegatzaileek hornitutako ostatua.<\/li>\n<\/ul>\n<div class=\"resaltado-petroleo\">190. Hitzarmenak eta 10\/2022 LOk sexu-askatasunaren berme integralari buruzkoa, enpresak diskriminaziorik gabeko eta emakumeen aurkako indarkeriarik gabeko lan-inguruak lortzen saiatzera behartzen ditu.<\/div>\n<\/div>\n<div class=\"resaltado-borde\">\n<p><strong><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2022-11589\" target=\"_blank\" rel=\"noopener\">Uztailaren 12ko 15\/2022 Lege Integrala, tratu-berdintasunari eta diskriminaziorik gabeko esparruari buruzkoa<\/a>: <\/strong>Esparru-arau horren xedea da tratu-berdintasuneko eta diskriminaziorik gabeko eskubidea, eta pertsonen berdintasuna eta duintasuna errespetatzea, Konstituzioaren 9.2., 10. eta 14. artikuluei jarraiki.<\/p>\n<\/div>\n<div class=\"resaltado-borde\">\n<p><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2023-15135\" target=\"_blank\" rel=\"noopener\">5\/2023 Errege Lege Dekretua, ekainaren 28koa, Ukrainako gerraren ondorio ekonomiko eta sozialei erantzuteko, La Palma uhartea berreraikitzen laguntzeko eta beste kalteberatasun-egoera batzuei erantzuteko zenbait neurri hartu eta luzatzen dituena; Europar Batasuneko zuzentarauen moldaketa, merkataritza-sozietateen egitura-aldaketei dagokienez eta gurasoen eta zaintzaileen familia-bizitza eta bizitza profesionala kontziliatzeari buruzkoa; eta Europar Batasuneko Eskubidea betearazi eta betetzeari buruzkoa<\/a>.<br \/>\nErrege Lege Dekretuaren bidez, Espainiako ordenamendu juridikoa Europar Parlamentuko eta Kontseiluko 2019ko ekainaren 20ko 2019\/1158 Zuzentaraua aldatu zen, gurasoen eta zaintzaileen familia-bizitza eta bizitza profesionala kontziliatzeari buruzkoa.<\/p>\n<p>Zuzentarauak erantzun egokia ematen dio familia eta laneko erantzukizunak batera artatzeko egoerari, hainbat eskakizun zehatzen esparruan eta horiei jarraiki, besteak beste, berdinagoak diren lan-harremanak eta sexuagatik ez diskriminatzearen printzipioaren aplikazio eraginkorra. Aipatutako zuzentarauak dio lanpostuak adingabeak haztetik eta mendekotasuna duten pertsonak eta adinekoak zaintzetik ondorioztatzen diren gorabehera desberdinetara egokitu behar direla, eta hainbat baldintza eraginkor ezartzen ditu, zereginak modu orekatuan banatzeko eta erantzunkidetasunez jarduteko.<\/p>\n<div class=\"resaltado-petroleo\">Laburbilduz, zuzentaraua aldatzeak martxoaren 1eko 6\/2019 Lege-Errege Dekretuaren hobekuntzak eta ekarpenak aberasten ditu, emakumeen eta gizonen artean, enpleguan eta okupazioan, tratu- eta aukera-berdintasuna bermatzeko premiazko neurriei buruzkoa, eta emakumezkoen jardunaldi bikoitza edo baimen luzeak bezalako gaietatik haratago egiten du, lan-formula malguen eta lanera joaten ez den egun-kopurua murriztearen alde. Horrek guztiak lan-esparruan benetako berdintasunean aurrera egiteko aukera ematen du, adiskidetze-eskubidea benetan aitortuz, langile ororen eskubideetako beste bat gisa.<\/div>\n<\/div>\n<p><a href=\"https:\/\/www.igualdad.gob.es\/normativa\/normativa-en-vigor\/\" target=\"_blank\" rel=\"noopener\">Estatu mailako araudia<\/a><\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-b447d86e47b66cbc8 fusion-toggle-has-divider\" style=\"--awb-title-color:var(--awb-color8);--awb-content-color:var(--awb-color8);\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_b447d86e47b66cbc8\"><a aria-expanded=\"false\" aria-controls=\"b447d86e47b66cbc8\" role=\"button\" data-toggle=\"collapse\" data-target=\"#b447d86e47b66cbc8\" href=\"#b447d86e47b66cbc8\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon fa-angle-down fas\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Autonomia Esparrua<\/span><\/a><\/h4><\/div><div id=\"b447d86e47b66cbc8\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_b447d86e47b66cbc8\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<div class=\"resaltado-borde\">\n<p><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2023-9168\" target=\"_blank\" rel=\"noopener\">1\/2023 Legegintzazko Dekretua, martxoaren 16koa, emakumeen eta gizonen berdintasunerako eta emakumeen aurkako indarkeria matxistarik gabe bizitzeko, Legearen testu bategina onartzen duena.<\/a><\/p>\n<p>Lege honen xedea da emakumeen eta gizonen arteko berdintasunaren esparruan, botere publikoen jarduna zuzendu behar duten<strong> printzipio orokorrak<\/strong> ezartzea, <strong>eta emakumeen eta gizonen arteko aukera- eta tratu-berdintasuna sustatzeko eta bermatzeko neurrien multzo bat araupetzea, bizitzaren esparru guztietan eta, zehazki, emakumeen ahalduntzea, autonomia sustatzea eta euren posizio soziala, ekonomikoa eta politikoa indartzea, egituren desberdintasuna eta, sexuan oinarritutako, diskriminazio guztiak ezabatzeko helburuarekin, baita emakumeen aurkako indarkeria matxista ere.<\/strong>\u00a0 \u00a0Hori guztia, berdintasuna duen eta indarkeria matxistarik ez duen gizarte bat lortzeko helburuarekin, non pertsona oro aske den, bai eremu publikoan eta bai pribatuan, euren gaitasun pertsonalak garatzeko eta genero araberako tradiziozko rolek inposatutako mugarik gabeko erabakiak hartu ahal izateko, non emakumeen eta gizonen jarrera, itxaropen eta premia desberdinak berdintasunez aintzat hartzen, baloratzen eta sustatzen diren.<\/p>\n<p>Hauek dira, emakumeen eta gizonen arteko berdintasun-esparruan, Euskadiko botere publikoen jarduna zuzendu eta bideratu behar dituzten printzipio orokorrak:<\/p>\n<ul>\n<li>Tratu-berdintasuna;<\/li>\n<li>Aukera-berdintasuna;<\/li>\n<li>Emakumeen aurkako indarkeria matxista prebenitzea eta ezabatzea;<\/li>\n<li>Dibertsitatearekiko eta desberdintasunarekiko errespetua;<\/li>\n<li>Genero-ikuspegia txertatzea;<\/li>\n<li>Jarduera positiboa;<\/li>\n<li>Generoaren araberako rolak eta estereotipoak ezabatzea;<\/li>\n<li>Sekzio arteko ikuspegia txertatzea;<\/li>\n<li>Sexu- edo genero-identitatea, orientazio sexuala, gorputzaren autonomia eta autodeterminazioa askatasunez garatzea;<\/li>\n<li>Ordezkapen orekatua;<\/li>\n<li>Lankidetza eta koordinazioa eta nazioarteratzea;<\/li>\n<li>Emakumeen ahalduntzea;<\/li>\n<li>Gizonen inplikazioa;
